As is known to all that, working as a law staff needs special qualification and the National Judicial Examination is a unified legal examination administered by China for people who work in the legal industry. This annual opportunity is precious for people who want to be a judge, a procurator or a lawyer.
Application Time and Requirements
The National Judicial Examination is held in the middle of September and lasts for two days. The application time is June annually. The time to confirm the site begins in the beginning of July. Candidates should qualify the following requirements:
1) Hold the nationality of the People's Republic of China
2) Upholding the “Constitution of the People's Republic of China” and enjoy the right to vote and the right to stand for election
3) Have completely civil capacity
4) Meet the conditions of diploma and majors prescribed in Law on Judges, Law on Prosecutors and Law on Lawyers
Application Documents and Procedure
1) The original and a copy of the education certificate
2) The original and a copy of personal identification (including ID card, temporary ID card, military ID card, soldier’s ID card, passport)
3) 3 recently-taken one inch, bareheaded, full-faced photos
4) Candidates applying in other places should provide the temporary residence permit card valid for one year or above issued by public security organs of their application location, and certificates of employment and training.
Examination Content
The National Judicial Examination mainly tests the legal knowledge of the tested persons and their ability to join the legal profession. The content includes Theoretical Law, Applied Law, Current Law Regulation, Practice of Law and Legal Ethics.
Each Examination (maximum 100 points) contains four papers:
Paper 1: Comprehensive knowledge, including Jurisprudence, Constitution, Economic Law, International Law, International Economic Law, Legal Ethics and Professional Responsibility.
Paper 2: Criminal and administrative justice system, including Criminal Law, Criminal Procedural Law, Administrative Law and Administrative Procedural Law
Paper 3: Legal System of Civil and Commercial, including Civil Law, Commercial Law and Civil Procedural Law (arbitration system).
Paper 4: Analysis of cases, including all subjects listed above.
Examination Results measure and Qualification Awarding
The annual number of passers and the qualified mark line of national judicial examination shall be publicized after the Ministry of Justice consults with the Supreme People's Court, the Supreme People's Procuratorate. Any one who passed the national judicial examination shall be awarded with Certificate of the Legal Profession Qualifications by the Ministry of Justice.
